'Smallville' star Allison Mack awaits sentencing for her involvement in the NXIVM cult – her 2019 guilty plea might help her avoid jail time.

Can Allison Mack avoid jail time? Learn what could save the ‘Smallville’ star

There are two high-profile sex trafficking cases tied up in the courts because of COVID-19. British socialite Ghislaine Maxwell is awaiting trial for her alleged role in Jeffrey Epstein’s sex trafficking ring. While Maxwell is more prominent in the news, Smallville star Allison Mack still awaits sentencing for her involvement in the NXIVM cult. 

Mack & Maxwell are taking drastically different approaches when it comes to their crimes. Maxwell pleaded not guilty and is fighting the charges, while Mack pleaded guilty in 2019, tearfully taking responsibility for her actions. Mack’s approach might help her avoid jail time, but the seriousness of the charges cast some doubt. 

Allison Mack’s charges 

Initially, Allison Mack was charged with multiple counts connected with the NXIVM cult and its leader Keith Raniere. These included racketeering, racketeering conspiracy, sex trafficking, sex trafficking conspiracy, and forced labor conspiracy. 

Mack pleaded guilty to racketeering & racketeering conspiracy last April. She’s currently awaiting her sentencing, but is currently unscheduled since 2019. Her sentencing was further delayed last spring by COVID-19. 

Mack was the head of NXIVM’s secret women-only group, DOS. NXIVM billed the “sisterhood” as a women’s empowerment group, but its purpose was to recruit young women to become sex slaves. Legal experts believe there wasn’t a strong enough case against Mack for the charges to stick. However, Mack allegedly was responsible for recruiting fellow actress India Oxenberg into the cult.

Allison Mack’s racketeering & racketeering conspiracy charges come with a max sentence of forty years in prison, twenty years for each charge. She pleaded guilty to avoid a trial and skip right to the sentencing. The question is: how close to the max sentence will Mack receive?

Reasons for a lowered sentence

Allison Mack could receive a sentence way lower than her maximum. Trial lawyer Page Pate explained she got a “very good deal” in his explanation of the deal to Law & Crime, adding: “The bottom line is this is a very good deal for her if there was sufficient evidence to support the sex trafficking charges. Perhaps there wasn’t, and that’s why she was allowed to plead to the lesser charges.” 

Mack was remorseful for her actions and believes she’s a changed person. She told the court back in 2019, “Through it all, I believed Keith Raniere’s intentions were to help people. I was wrong. I must take full responsibility for my conduct, and that is why I am pleading guilty today. I am and will be a better person as a result of this.”

Allison Mack initially pleaded not guilty with NXIVM leader Keith Raniere and became a co-defendant in the case. The change in her story could be because she worked with authorities to build a case against Raniere, who was sentenced to 120 years in prison. It would also explain why she is pleading to the lesser charges and why she might receive a short sentence. Mack is also a first-time offender, another factor for a shorter sentence. 

Reasons for a higher sentence

There’s still a good possibility for Allison Mack to receive the maximum sentence for her racketeering & racketeering conspiracy charges. A judge will consider Mack’s “relevant conduct” when deciding her sentencing — sex trafficking, sex trafficking conspiracy, and forced labor conspiracy charges don’t bode well for a shortened sentence. 

According to Law & Crime Network host Bob Bianchi, “Even though she didn’t plead specifically to the sex crimes, the upward relevant conduct is not good for her. Many victims, serious harm, extortive conduct, and length of time conduct was occurring all inure to her detriment.” 

Bianchi also explained Mack could downplay her involvement by claiming she’s a victim. He added her defense could explain “[she was] brainwashed to a point she didn’t know what she was doing was wrong, or appreciate the seriousness of the harm she was doing.” She could also follow Raniere’s defense team and claim the women were consenting adults and knew what they were getting themselves into.

    • I would bet that she will see little to no time. She is an attractive female and a hollywood sweetheart. It bogles the mind that Raniere would get 120 years !! While he too is guilty as sin, we have murderers and embezzlers and politicians and their families who have done far worse, but are given minimal sentences which are eventually reduced and they become social heroes.

  • I think she’s probably always been a little lost and manic, and thus easy to take advantage of. It’s likely what drew her to Rainer in the first place. There is always a dominant personality in a relationship like that and it clearly wasn’t her.

    That being said, I think she should be sentenced to therapy and to live in a halfway house where she can work with other women who have been hurt, and may have hurt others in turn. That way she can actually grow as a person instead of being thrown in a hole to rot for X number of years.

    Prison should be reserved for truly terrible people, not those who have a chance at being redeemed.

  • she was invited to NXIVM by her Smallville costar Kristen Kruek. She has the appearance of someone who could be easy influenced. I think she is a victim just like all the others. Was any of this her ideas? Why is she a leader? Is she different from any of the other branded women? Who appointed her leader?

BUT, we ALL KNOW – here in America – when a celebrity (or in Allison’s case, a VERY SMALL CELEBRITY) – how the judicial system works for celebrities: she’ll JUST GET a “slap on the wrist” & probably won’t get ANY prison time. ANY other American citizen in her EXACT SHOES, so to speak, would automatically get 40 years!! But NOT a celebrity; probation at the VERY MIST! Absolutely Sickening how there are two sets of rules for celebrities and non-celebrities! The former, 99 times out of 100, will never suffer the repercussions of their crimes while the latter, will get the full extent of the law! Why are there two standards, as there have always been, four celebrities and non-celebrities? It’s absolutely pathetic and time will prove this to be true! It never changes! Celebrities are always endowed with not just the benefit of doubt, but the benefit of complete innocence!!!

        And all the comments regarding being brainwashed, everybody knows that’s a bunch of BS! Again, if a common, law abiding regular citizen or to do the same thing, that get 40 years despite a defense of being brainwashed. When is it ever going to apply, punishment that is, to both celebrities and non-celebrities alike?!? When America; when judicial system; and, most importantly, when juries and judges?

    • Wow well I was a fan of her when smallville came out. But since I heard this I’m not her fan no more but I don’t hate her or she deserve to be in prison. We can forgive. I think that she know what she was doing but I also think that she was brainwashed to and she much a victim just like everyone else.   • Mack was a Master, that tells me she KNEW what she was doing. Mack was the one who spoke to the cult leader and did his bidding by telling the women to send her emails of their family secrets to hold against the recruits, Mack was the one who took naked photos of the “recruits” and sent them to the cult leader.
    Mack didn’t know that was wrong? I don’t think do. I believe she knew what she was doing. Mack even wore a torture device to cause her pain, that she would wear all day so she would continue to do the cult leaders bid 24/7.

  • In watching the series onTV, India Oxenberg explains how Allison requested all the DOS girls needed to be photographed naked. When she wasn’t satisfied she wanted to ‘take pictures of your pussies”. She was also involved in the branding! So I’ll let everyone decide on their own if she should get jail time.

Sex trafficking, being a LEADER in this cult, branding, forced labor…she needs at least close to the max sentence.   • I still cannot see her motivation for her conduct. She got nothing out of it, other than whatever emotional needs were fulfilled by being a top henchman-plus-victim to Raniere. Being just a few years older than her and bit of a nerd I watched Smallville, i always liked her character and thought she great. of course this does not say anything about the actress herself in real life. Bu still I feel she should get psychological help instead of jail time.

    Yes people were hurt, by blackmail, by branding, by being used for sex. But I believe she was used as a puppet by a evil puppet master,. who saw her as an easy pray to complete his dark desires. In the documentary/tv series you see an early interview, about the cult leader, and that he prayed before on children. And even explained how to abuse children to his followers, so in this case whole criminal justice system has failed before. He should not even have been free to start a cult or to publicly preach about such things! So I really hope Allison Mack gets psychological help and maybe a community sentence, so she can be reprogrammed and heal herself and in the end to lead a normal life and become the great actress she once was before.

How is she different from Nikki Clyne? Why is she free and AM faces 40 years?   • India Oxenberg was completely brainwashed but still didn’t relish in the potential power to hurt others and she did not follow through with it. Allison took the ball and ran with it. Her follow thru and enthusiasm for this evil helped facilitate how big the thing actually became. Her being ‘brainwashed’ is not an excuse. She was the brainwasher. This wouldn’t have happened without her twisted, evil intentions. If there’s a reason for just time in this country – punishment, a deterrent to stop others from this kind of shit – she deserves it.
